Requesting usage of Starcon universe for a game

I've been creating this game. Blasteroid warz. Wich is a top down battle game (like SC melee). I have my own story, own ships, own layout. But as a endboss, I used the Ur-Quan dreadnought. Without any story attaching it to the Starcon universe. I recreated (poorly) the theme song of the Ur-Quan, and their winning ditty, and made the password for this level Ur-Quan.

Can I (freely) distribute this game, or should I get in contact with fred & co?

Update: If you want I can post both the midi's and a screenshot of the level. And if you can provide webspace, maybe even the game itself.

The Re-release of Starcontrol 2, which is called "The Ur-Quan Masters", is open-source.  unless I completey misunderstand copyright law, as long as your game is relesed under the GNU liscence it is legal.

It is basically a software liscence that makes the material free and open source.  One of the restrictions is that anyone who uses something from a program with the liscence must release the material under the same liscence -- free and open-source.  Since UQM (http://sc2.sourceforge.net jic you don't have it yet) is under the GNU liscence, I am fairly sure you can use the "Ur-Quan Dreadnaught clone" safely if you use GNU as well.  If you are really worried though, contact Toys for Bob and ask!
