Re: Sequels strife

Anything we can take away from that or is that pretty standard procedure? Not much, other than that the Judge(s) appear to be running out of patience with this procedural bickering, and are unlikely to look well on the parties attempting to delay or complicate things further without a very good rea...

Re: Sequels strife

To English, please? https://www.courtlistener.com/docket/6239751/106/stardock-systems-inc-v-paul-reiche-iii/ Stardock was trying to get a last minute delay on Brad's deposition. P&F opposed a delay , and the Judge denied Stardock's request , so Brad was presumably deposed yesterday (Monday, Feb 11)...

Re: Sequels strife

https://www.scribd.com/document/398564711/Letters-from-Stardock-to-Valve-and-GOG-regarding-DMCA-claims-of-Ford-and-Reiche Note that that was Stardock's argument to Valve and GOG about why they should put the games back up. It does not necessarily mean that Valve and/or GOG agreed with that argument...

Re: Sequels strife

One thing I do wonder about, why did Paul and Fred decline buying the Star Control trademark from Stardock? Was it just because of the cost? They probably thought Stardock overpaid for it, so even though they were offered it "at cost", they didn't consider it worth the price. And if so, how would t...

Re: Sequels strife

Interesting, the link to the alleged e-mail from USPTO trademark examiner to F&P. FYI, Stardock misidentifies the guy as being from the USPTO; he actually works for the Copyright Office, which is a different department. And yes, as his use of "generally" implies, he's not speaking with legal precis...

Re: Sequels strife

So, for those who are utterly clueless about legal proceedings and such especially as they pertain to copyright laws, what impact will all this have on the overall case? Was this just a nominal first victory that hurt Stardock in the pocketbook, or does this bode well for the overall lawsuit? It's ...

Re: Sequels strife

I prefer to think of it that initially all was in good faith and an honest misunderstanding, only when shareholders got involved, Stardock begun digging their heels in and it got ... messy... That would be nice. However, as near as I can tell, Stardock has only two shareholders: Brad and his wife. ...

Re: Stardock CEO threatens to "eliminate" this community

There is one thing I thought of – what kind of ground would Stardock gain if they somehow proved that neither F&P nor Accolade owned the copyright to SC1 or SC2 when they were created? Well, if P&F don't have the copyright, Stardock can't be forced to pay them any money for violating it. If the 198...

Re: Stardock CEO threatens to "eliminate" this community

Like it or not, we are using trademarked terms and copyrighted imagery, and who owns those rights is exactly what is in dispute here. The images are completely safe, IMHO, as they are governed by copyright, not trademark, and Stardock is not claiming the copyright for itself, but rather on behalf o...

Re: Stardock CEO threatens to "eliminate" this community

Wait wait wait... Exactly how do they have the rights to "eliminate" this community? This is generally concerning although i might not be up to date with events. As Krulle suggested, the danger is through Stardock's trademark claims. If they own the trademark to "Star Control" (as seems likely), th...
